Kellogg’s Is Facing a Berry Curious $5 Million Lawsuit Over Their Strawberry Pop-Tarts
Kellogg’s is in a bit of a jam regarding their Strawberry pop tarts. 🍓
USA Today is reporting that Kellogg’s is getting popped with a lawsuit over the ingredients of its strawberry-flavored Pop-Tarts.
A lawsuit has been filed against Kellogg’s by a consumer named Anita Harris in the Southern District of Illinois. She alleges that the onlinepany is misleading people by promoting Pop Tart’s strawberry filling in its labels and marketing, leading consumers to believe that the fruit filling contains “a greater relative and absolute amount of strawberries than it does.”
Ms. Harris claims that Pop-Tarts “cannot provide a true strawberry taste” since any strawberries are overpowered by “significant amounts” of pears and apples. She’s also claiming that red food coloring gives consumers “the false impression” that the pastries contain more strawberries than they actually do. 😱
The product’s nutrition label shows that the frosted strawberry toaster pastries contain 2% or less of dried strawberries, dried pears, dried apples, and red 40, but Harris’ lawsuit says that if she had known the truth, she would not have bought the Pop-Tarts at the price she paid. 😜
Ms. Harris’ original lawsuit has now evolved into a class-action lawsuit open to consumers in New York, Kansas, Wyoming, and Delaware who purchased Pop-Tart brand Whole Grain Frosted Strawberry Toaster Pastries.
Kellogg’s has yet to respond to this legal action, but it’s interesting to note that the same attorney filed a similar lawsuit against the onlinepany last year. Kellogg’s filed a motion to dismiss that lawsuit, stating:
“The confusion the plaintiff claims to have suffered does not pass the straight-face test.” 😁
